The Historic England Foundation: Donation Terms and Conditions

Words used in these terms and conditions

In these Donation Terms and Conditions, the following definitions and rules of interpretation apply.

‘The Foundation’, ‘it’ or ‘its’ means The Historic England Foundation incorporated and registered in England and Wales with company number 10564101 and registered charity number 1178368, whose registered office is at The Engine House, Fire Fly Avenue, Swindon, SN2 2EH.

‘You’ means the donor and shall include that party's personal representatives, successors or permitted assigns.

‘Historic England’ means The Historic Buildings and Monuments Commission for England, a non-departmental public body whose head office is at 4th Floor, Cannon Bridge House, 25 Dowgate Hill, London, EC4R 2YA.

1. Headings shall not affect the interpretation of these terms and conditions
2. Words in the singular shall include the plural and vice versa
3. A reference to a statute, statutory provision or subordinated legislation is a reference to it as it is in force from time to time, taking account of any amendment or re-enactment and includes any statute, statutory provision or subordinate legislation which it amends or re-enacts
4. Any words following the terms ‘including’, ‘include’, ‘in particular’, ‘for example’, or any similar expression shall be construed as illustrative and shall not limit the sense of the words, description, definition, phrase or term preceding those terms

The agreement

By confirming on the Foundation’s website that you wish to make a donation, you agree to be bound by these terms and conditions for that donation.

Making a donation on these terms and conditions does not constitute the creation of a contract. The Foundation has complete discretion over whether to accept a donation. It reserves the right to decline a donation for any reason whatsoever and provide a full refund. The agreement between you and the Foundation will be entered into once the Foundation has accepted your offer and processed your donation.

Your donation

The Foundation will use your donation at its discretion but within its stated charitable objectives of supporting the work of Historic England.

All donations through the Foundation’s website are to be made via its payment services provider, Global Payments. By confirming that you wish to proceed with your donation, you authorise Global Payments (or any other payment services provider the Foundation may use from time to time) to request funds from your credit or debit card provider.

When you donate to the Foundation through its website and confirm that you are a UK taxpayer in accordance with the requirements of the Gift Aid scheme as they apply from time to time, the Foundation can reclaim Gift Aid. It is your responsibility to determine whether you qualify for Gift Aid. The Foundation is not able to provide any form of legal, financial or taxation advice in this regard. These terms and conditions only relate to one-off donations made through the Foundation’s website. If you wish to make regular donations, please get in touch with the Foundation via email at [email protected]

As a registered charity, the Foundation is subject to regulation by the Charities Commission for England and Wales under The Charities Act 2011. As a rule, charities are not permitted to refund any donations. However, there may be exceptional circumstances. Your personal information

Before a donation can be processed, you must provide the Foundation with:

1. your name, address and email address
2. details of the credit or debit card you wish to use to fund the donation

This information will be used to process the donation. It is your responsibility to ensure that you have provided the Foundation with the correct information.

By donating, you agree that any personal information provided with the donation may be held and used by the Foundation or its agents and suppliers to administer the donation.

All personal data provided to the Foundation will be held and processed in accordance with the requirements of all legislation and regulatory requirements in force from time to time relating to the use of personal data and the privacy of electronic communications, including:

1. the Data Protection Act 2018 and any successor UK legislation
2. the UK GDPR
3. the Privacy and Electronic Communications Regulations 2003 (SI 2003/2426) as amended

We will keep your personal data safe and secure. We will not share it with other organisations without your knowledge and consent unless required by law. We will keep your personal data only for the purposes of communicating with you regarding this donation. You have the right to withdraw your consent at any time. The withdrawal of consent will not affect the lawfulness of processing your data based on your consent before its withdrawal.

When you submit your payment details, these details will be transferred to the Foundation’s payment services provider, Global Payments. Your payment data will be collected and processed securely by Global Payments. Global Payments’ terms and conditions are different from those of the Foundation. Before you make a donation, make sure that you are aware of Global Payments Privacy Policy to ensure that you are comfortable with how Global Payments will process your personal data. 

This donation is in no way endorsed, administered by, or associated with Twitter, Facebook, Instagram or any other social network. You are providing your information to the Foundation and Historic England and not to any other party. The information provided will be used in conjunction with Historic England’s Privacy Policy.

These terms will be governed by and construed in accordance with the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England.
